What is a General Law Search?
A General Law search is a specialised title investigation that reconstructs the historical chain of ownership of land by reviewing memorials, deeds, mortgages, conveyances and other historical records. The purpose of the search is to establish a valid chain of title and confirm the ownership and status of the land.
General Law searches are often highly technical and require detailed analysis of historical records held by the Victorian Land Registry and the Public Record Office Victoria (PROV).
Before the introduction of the Torrens title system in Victoria, land ownership was proven through a historical chain of deeds known as “General Law” title. Although most land in Victoria is now under the Torrens system pursuant to the Transfer of Land Act 1958 (Vic), some parcels still rely wholly or partly on historical General Law evidence.
Why Are General Law Searches Needed?
General Law searches may be required where:

land remains wholly or partly General Law land;
-
a title contains a warning such as a “Provisional Title” warning;
-
there are gaps or irregularities in the chain of title;
-
land is being brought under the Transfer of Land Act 1958 (Vic);
-
there are issues involving adverse possession or possessory title;
-
a subdivision, development or transfer requires title clarification;
-
land boundaries, dimensions or easements are uncertain;
-
historical road status or remnant land issues arise; or
-
original deeds or historical ownership records need to be reconstructed.
In many cases, these issues are not discovered until a sale, subdivision, refinancing or development is underway, which can create significant delays if not identified early.

Provisional Titles and Historical Title Issues
A common reason for a General Law search is the existence of a “Provisional Title” warning on a title search.
A provisional folio generally means the land was brought under the Transfer of Land Act without full certification of the historical chain of ownership. The title is therefore not yet fully guaranteed by the Registrar of Titles and additional title investigations are required.

The General Law Search Process
A proper General Law search can involve:

reviewing LASSI and historical title plans;

tracing historical memorials and deeds;

identifying the “good root of title”;
-
reviewing Crown Grants and historical conveyances;
-
searching PROV records and historical registers;
-
analysing easements and historical rights;
-
reviewing adverse possession records;
-
investigating section 26F and 26J records under the Transfer of Land Act 1958 (Vic); and
-
preparing detailed title evidence for conversion or transaction purposes.
These searches often require detailed legal interpretation and historical title analysis, particularly where documents are incomplete, inconsistent or affected by historical dealings.

Where a provisional title exists:

a solicitor’s certification process may be required;

a conversion application under section 14 of the Transfer of Land Act 1958 (Vic) may need to be completed; and
-
settlement, subdivision or development may be delayed until the title issues are resolved.
